Bei den Versteigerungen handelt es sich um öffentliche Auktionen der Leipziger Münzhandlung und Auktion Heidrun Höhn e. K.. Versteigerer ist die Leipziger Münzhandlung und Auktion Heidrun Höhn e.K. mit den Auktionatoren Saskia Höhn und Christina Höhn.
Die Teilnahme an der Auktion ist nur denjenigen Kunden gestattet, die sich im Vorfeld auf der Homepage
www.leipziger-muenzhandlung.de registriert oder ein schriftliches Gebot geschickt haben.
Durch Abgabe eines Gebotes erkennt der Kunde diese Bedingungen an. Jedes Gebot des Kunden bei den Internet-Auktionen des Versteigerers stellt ein verbindliches Angebot zum Abschluss eines Kaufvertrages dar. Dieses ist für den Kunden so lange verpflichtend, bis es von einem anderen Kunden überboten wurde oder
die Versteigerung des Stückes ohne Erteilung eines Zuschlages beendet wurde. Ein Vertrag kommt erst durch Zuschlag des Auktionators zustande. Der Zuschlag erfolgt nach dreimaliger Benennung des höchsten Gebotes und verpflichtet zur Abnahme und zur Zahlung des kompletten Rechnungsbetrages. Sowohl mit der Registrie- rung als auch mit der Abgabe eines Gebotes werden die Allgemeinen Versteigerungsbedingungen akzeptiert. Es bleibt dem Versteigerer vorbehalten, Personen aus besonderen Gründen von der Teilnahme an der Verstei- gerung auszuschließen.
Die Versteigerung erfolgt im Auftrag und für Rechnung der Eigentümer unter Einhaltung der sich aus der
Versteigerungsordnung (BGBl I 1976, 1346) ergebenden und für Kommissionäre geltenden gesetzlichen Be-
stimmungen des BGB und HGB gegen Barzahlung des Kaufpreises in EURO-Währung.
3. Katalog

Die im Online-Katalog angegebenen Preise sind Schätzpreise. Die Mindestgebote liegen bei 90% der Schätzpreise.
Der Nachverkauf der nicht während der Auktion versteigerten Ware erfolgt, wenn nicht anders limitiert, zu 90 % des Schätzpreises plus Aufgeld und Mehrwertsteuer.
Der Zuschlagspreis bildet die Berechnungsgrundlage für das vom Kunden zu zahlende Auf-geld für deutsche Sammler von 20 % inkl. der gültigen MwSt. Kursgültige Goldmünzen sind umsatzsteuerfrei; der Auktiona- tor behält sich jedoch eine Nachberechnung der Umsatzsteuer für solche Stücke vor, die nicht in einem vom Bundesfinanzministerium noch zu erstellenden Katalog enthalten sind. Goldmünzen, die von der Umsatz- steuer befreit sind, werden mit einem Aufgeld von 15 % berechnet. Händler, die ihren Geschäftssitz in einem EU-Mitgliedsstaat haben, werden gebeten, bei ihren Geboten ihre Umsatzsteuer-Identifikationsnummer (UST-IdNr.) anzugeben, damit die ersteigerte Ware umsatzsteuerfrei geliefert werden kann.
Ausländischen Kunden aus Ländern, die nicht Mitglied der EU sind, wird ein Aufschlag von 15 % auf den Zuschlagspreis berechnet. Sie erhalten die Lieferung nur gegen Zahlung des Kaufpreises in EURO-Währung. Es ist bankspesenfrei zu zahlen.
Versteigerungsbedingungen
Die nachfolgenden Allgemeinen Versteigerungsbedingungen gelten für alle Rechtsgeschäfte zwischen der Leip- ziger Münzhandlung und Auktion Heidrun Höhn e. K. (i. F. Versteigerer) und den Kunden und Ersteigerern
(i. F. Kunden) im Rahmen der Internet-Auktionen des Versteigerers. Allen Änderungen dieser Versteigerungs- bedingungen wird hiermit ausdrücklich widersprochen, ist ein Widerspruch ausgeschlossen, so treten anstelle dieser die gesetzlichen Bestimmungen in Kraft. Abweichende Einkaufsbedingungen finden nur Anerkennung, wenn sie von uns schriftlich bestätigt worden sind.
2. Vertragsschluss

4.1 Der Versand geht zu Lasten des Kunden bzw. Empfängers. Ausländische Kunden kaufen nach den Devisenbestimmungen ihres Landes; der Auktionator lehnt jede Haftung für Folgen, die sich aus Verstößen hiergegen ergeben können, ab. Versandformalitäten werden vom Versteigerer besorgt. Die Versandkosten betragen für Deutschland 7,90 EUR; für die Staaten der EU 15,00 EUR und für Nicht-EU-Staaten je nach Auf- wand, jedoch maximal 30,00 EUR
5. Zahlung
5.1 Die Zahlung des Kaufpreises ist 10 Tage nach Ausstellung der Auktionsrechnung fällig. Eine Stundung des Rechnungsbetrages ist nicht möglich. Der Versteigerer behält sich vor, Kunden, die kein ausreichendes Depot hinterlegt haben, eine Vorauskasse-Rechnung zuzusenden. In diesem Fall wird die ersteigerte Ware unmit- telbar nach Zahlungseingang des Rechnungsbetrages an den Kunden versandt. Im Verzögerungsfalle ist der Versteigerer berechtigt, ab Zuschlagsdatum Zinsen (1,5 % pro Monat) in Rechnung zu bringen.
5.2 Wird die Zahlung nicht sofort an den Versteigerer geleistet oder die Abnahme der zugeschlagenen Sache verweigert, wird die Sache nicht an den Kunden übergeben. Der Kunde verliert seine Rechte aus dem Zuschlag und die Sache kann auf seine Kosten erneut versteigert werden. Der Kunde haftet bei geringerem Erlös für den Ausfall; auf einen etwaigen Mehrerlös hat er keinen Anspruch.
6. Versteigerung
Versteigerungsbedingungen
6.1 Der Zuschlag erfolgt elektronisch nach dreimaligem Ausruf des höchsten Gebotes und verpflichtet den Kunden zur Abnahme.
6.2 Die ersteigerte Ware bleibt bis zur vollständigen Bezahlung aller Forderungen Eigentum des Verkäufers.
6.3 Soweit nicht anders vermerkt, gelten im Übrigen die Allgemeinen Versteigerungsbestimmungen und,
auch im Verhältnis zu ausländischen Kunden, gilt deutsches Recht.
6.4 Schriftliche Aufträge werden von uns ohne Auftragsprovision gewissenhaft ausgeführt. Aufträge von uns
unbekannten Kunden können nur ausgeführt werden, wenn ein Depot hinterlegt wird oder Referenzen be- nannt werden. Schriftliche Aufträge bitten wir frühzeitig einzusenden. Bei mehreren gleich hohen Geboten erhält das zuerst eingegangene den Zuschlag. Unlimitierte Aufträge haben keinen Anspruch auf unbedingte Ausführung.
7. Mängelhaftung
7.1 Die Beschreibung im Katalog ist gewissenhaft durchgeführt. Sie begründet jedoch keine Rechts- oder Sachmängelhaftung gemäß §§ 434, 459 ff. BGB. Die Angabe der Erhaltung ist streng nach den im deutschen Münzhandel üblichen Erhaltungseinstufungen vorgenommen und gilt als persönliche Beurteilung. Die bei- gedruckten Preise sind Schätzpreise. Beanstandungen sind unverzüglich, spätestens jedoch innerhalb von 8 Tagen nach Erhalt der Ware schriftlich geltend zu machen. Nicht erkannte gefälschte Auktionsware wird gegen Erstattung des Kaufpreises zurückgenommen. Ausgenommen sind Orden und Ehrenzeichen. Für diese Stücke übernehmen wir keine Echtheitsgarantie. Sämtliche Ansprüche wegen begründeter Beanstandungen sind
auf den Netto-Rechnungswert der jeweils zugrundeliegenden Lieferung beschränkt. Im Übrigen haften der Versteigerer und seine Angestellten nur, falls ihnen vorsätzliches oder grob fahrlässiges Verhalten vorgeworfen werden kann. Nummern mit mehreren Münzen (Lots) sind nach dem Zuschlag von Beanstandungen (Fäl- schungen ausgenommen) ausgeschlossen. Soweit es sich bei den Stückzahlen des Lots um Circa-Angaben im Katalog handelt, haftet der Versteigerer nicht für abweichende Stückzahlen.
7.2 Sollten gelieferte Artikel offensichtliche Mängel aufweisen, wozu auch Transportschäden zählen, so reklamieren Sie solche Mängel sofort schriftlich, durch telefonische Vorankündigung oder durch Rücksendung der Ware. Die Versäumnis dieser Rüge hat allerdings für Ihre gesetzlichen Ansprüche keine Konsequenzen.
7.3 Sollte sich wider Erwarten ein Stück als falsch herausstellen, ist die Gewährleistung auf die Höhe des Zuschlagspreises plus Aufgeld beschränkt. Bei nicht zu lösenden Meinungsverschiedenheiten kann der Verstei- gerer einen Sachverständigen seiner Wahl beauftragen, wobei die Kosten der unterlegenen Partei in Rechnung gestellt werden.
8. Erfüllungsort ist für beide Teile Leipzig. Für alle Streitigkeiten aus oder in Zusammenhang mit der Versteigerung ist der Gerichtsstand Leipzig, sofern es sich bei dem Kunden um einen Vollkaufmann handelt.
9. Solange Kataloginhaber, Auktionsteilnehmer und Kunden sich nicht gegenteilig äußern, versichern sie, dass
sie den Katalog und die darin enthaltenen zeitgeschichtlichen und militärhistorischen Gegenstände aus der Zeit 1933-1945 nur zu Zwecken der staatsbürgerlichen Aufklärung, der Abwehr verfassungswidriger und ver- fassungsfeindlicher Bestrebungen, der Kunst oder Wissenschaft, der Forschung oder der Lehre, der Aufklärung oder der Berichterstattung über die Vorgänge des Zeitgeschehens oder der Geschichte oder ähnlichen Zwecken dient (§§ 86a, Abs. 3, StGB).
Die Firma Leipziger Münzhandlung und Auktion Heidrun Höhn e.K., Inhaber Manfred Höhn, der Versteige- rer und seine Einlieferer bieten diese Gegenstände nur unter diesen Voraussetzungen an. Mit der Abgabe von Geboten für Gegenstände, die mit Emblemen des Dritten Reiches versehen sind, verpflichtet sich der Bieter dazu, diese Dinge nur für historisch wissenschaftliche Zwecke aus oben genannten Gründen zu erwerben und in keiner Weise propagandistisch, insbesondere im Sinne der § 86a StGB, zu benutzen.
